Terms of service
§ 1 General provisions
- The Moody online store, available at the Store's domain (hereinafter: "Store"), is operated by Marharyta Prybylova, conducting a sole proprietorship business under the name Moody Marharyta Prybylova, registered with the Central Register and Information on Economic Activity (CEIDG), NIP (Tax ID): 6762714327, REGON (Statistical ID): 544185544, correspondence address: ul. Mogilska 40/35, 31-546 Kraków, Poland (hereinafter: "Seller").
- The Seller can be contacted by email at: enjoy@moodyeurope.com or in writing at the address given in paragraph 1.
- These Terms of Service are addressed to consumers and set out the rules and procedure for concluding a Sales Agreement at a distance via the Store.
- The Store sells exclusively to individuals of legal age (18 years or older), due to the nature of the products offered. By placing an Order, the Customer confirms that they are at least 18 years old.
- The Store operates on the Shopify platform, which enables the Seller to provide electronic services.
§ 2 Definitions
- Store — the online store operated by the Seller.
- Customer — a natural person with full legal capacity who has reached the age of 18, placing an Order in the Store as a consumer.
- Consumer — a Customer who is a natural person, performing a legal transaction not directly related to their business or professional activity.
- Product — an item presented in the Store, which is the subject of a Sales Agreement.
- Sales Agreement — a distance sales agreement for a Product, concluded via the Store, between the Customer and the Seller.
- Order — a declaration of intent by the Customer aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Product.
§ 3 Technical requirements and use of the Store
- To use the Store, including browsing the product range and placing Orders, the following are required: a device with internet access, an up-to-date web browser, and an active email account.
- Using the Store does not require creating a user account — Orders are placed as a guest checkout.
- The Customer is obliged to use the Store in a manner consistent with the law and good practice, and in particular not to submit any unlawful content.
§ 4 Conclusion of the Sales Agreement
- The Sales Agreement is concluded when the Customer places an Order in the Store and the Seller confirms it.
- Placing an Order involves: selecting a Product and adding it to the cart, choosing a delivery and payment method, providing the information necessary to fulfill the Order, confirming that the Customer has read these Terms of Service and the Privacy Policy, and then clicking the button confirming the Order with an obligation to pay.
- After placing an Order, the Customer receives a confirmation of its acceptance at the email address provided, which is equivalent to the conclusion of the Sales Agreement.
- The Sales Agreement is concluded in Polish or English, depending on the language version of the Store selected by the Customer.
§ 5 Prices and payment methods
- Product prices displayed in the Store are gross prices (including VAT) and are expressed in Polish złoty (PLN) or euro (EUR), depending on the delivery country selected by the Customer.
- The price shown for a Product at the time the Order is placed is binding on both the Seller and the Customer.
- A delivery cost may be added to the Product price, shown to the Customer before the Order is placed.
- Payment for an Order is made through a third-party electronic payment operator, integrated via the Shopify platform — Shopify Payments.
- The Seller does not store the Customer's payment card data — this data is processed directly by the payment operator.
§ 6 Delivery
- Delivery is carried out within Poland and selected European Union countries, as indicated in the Store when placing an Order.
- Delivery is carried out via the courier companies DPD and InPost (courier delivery), or to an InPost Paczkomat (parcel locker), depending on the option chosen by the Customer.
- The delivery cost and estimated delivery time are shown to the Customer before the Order is placed.
- Due to the nature of our product range, parcels are shipped in discreet, neutral packaging with no indication of their contents.
§ 7 Right of withdrawal (returning a Product)
- A Consumer who has concluded a Sales Agreement at a distance may withdraw from it within 14 days of receiving the Product, without giving a reason.
- To meet this deadline, it is sufficient to send a statement of withdrawal before it expires, to the email address enjoy@moodyeurope.com, or by shipping the returned Product.
- Hygiene exception. In accordance with Article 38(5) of the Polish Consumer Rights Act of 30 May 2014, the right of withdrawal does not apply to Products delivered in sealed packaging which, for health or hygiene reasons, cannot be returned once the packaging has been opened after delivery. This applies in particular to intimate products whose hygiene seal or protective film has been broken.
- The cost of returning the Product is borne by the Customer.
- The Seller will refund the payment received without undue delay, no later than within 14 days of receiving the returned Product, using the same payment method the Customer used.
- Detailed rules and the return procedure are described in the "Returns and Complaints" document available in the Store.
§ 8 Complaints (statutory warranty)
- The Seller is liable to the Consumer for the conformity of the Product with the Sales Agreement, in accordance with the Polish Consumer Rights Act of 30 May 2014 (rękojmia / statutory warranty), for a period of up to 2 years from the date of delivery of the Product.
- A complaint may be submitted by email to enjoy@moodyeurope.com, including a description of the non-conformity, the Order number, and, where possible, photographic documentation.
- The Seller will respond to the complaint within 14 days of receiving it.
- If the complaint is accepted, the cost of returning the Product is borne by the Seller.
- The detailed complaint procedure is described in the "Returns and Complaints" document available in the Store.
§ 9 Out-of-court dispute resolution and claims procedures
- The Consumer has the option to use out-of-court methods of handling complaints and pursuing claims, including seeking assistance from the locally competent Provincial Inspector of Trade Inspection or a standing amicable consumer court.
- Detailed information on the possibility of using out-of-court complaint handling procedures is available on the website of the Office of Competition and Consumer Protection (UOKiK): uokik.gov.pl.
- A Consumer residing in the European Union may also use the EU's online dispute resolution platform (ODR platform), available at: ec.europa.eu/consumers/odr.
§ 10 Personal data
The rules for processing Customers' personal data are described in the Privacy Policy, available in the Store.
§ 11 Final provisions
- The Seller reserves the right to amend these Terms of Service for valid reasons (e.g., changes in the law, changes to payment or delivery methods, changes to the Store's functionality). Amendments do not affect Sales Agreements concluded before they take effect.
- The current version of these Terms of Service is always available on the Store's website.
- In matters not regulated by these Terms of Service, the applicable provisions of Polish law shall apply, in particular the Polish Civil Code and the Consumer Rights Act.
- These Terms of Service take effect on the date of publication in the Store.
